Subsection 3: Procedure for setting up a regional hospital grouping

I.-The agreement establishing the regional hospital grouping is drawn up by the directors, the chairmen of the medical committees and the chairmen of the nursing, rehabilitation and medico-technical care committees of the establishments participating in the regional hospital grouping and, where an army hospital is associated with the grouping, by the staff occupying functions equivalent to those mentioned for the participating establishments.

It is subject to :

1° For public health establishments that are part of the grouping, after consultation with the management boards, to their establishment technical committees, their establishment medical committees and their nursing, rehabilitation and medico-technical care committees, and then to their supervisory boards, for their opinion ;

2° For public medico-social establishments or services that are part of the grouping, to their establishment technical committees, for their opinion. It is then submitted to their boards of directors for deliberation.

3° For the army hospitals associated with the grouping, to the chief medical officer of the army hospital, for an opinion.

The founding agreement is signed by the directors of the establishments involved in the grouping and, after authorisation from the Minister for Defence, by the chief medical officer of the armed forces hospital involved in the grouping and submitted for approval to the director general of the relevant regional health agency. If no response is received within two months of receipt, this is deemed to be approval. The approval decision, or the certificate of tacit approval, is published by the Director General of the Regional Health Agency.

II - In the event of non-conformity of the constitutive agreement or substantial modification of the regional health project, the Director General of the Regional Health Agency will order the establishments that are party to and associated with the consortium to bring the agreement into conformity within a period that he will notify to the establishments, which may not be less than one month.

If the agreement has not been brought into line by the end of this period, the director general of the competent regional health agency shall proceed to do so and shall approve the agreement establishing the regional hospital grouping, after obtaining the agreement of the Minister of Defence if an army hospital is associated with the grouping.

In the absence of the agreement of the Minister of Defence, the association of the army hospital with the group is deemed to have lapsed.
